Legal commentator and retired attorney Mark Pulliam detailed two recent major federal court rulings as evidence of what he called a growing “judicial insurrection.”
The first case centers on a decision by U.S. District Court Judge Allison D. Burroughs, who, last week, blocked the federal government from ending parole and work authorization for migrants who entered through the CBP One app.
The second case involves U.S. District Court Judge Richard Leon, who, also last week, ordered a temporary halt to construction of a $400 million White House ballroom directed by President Donald Trump.
In an interview Monday on The Michael Patrick Leahy Show, Pulliam argued that both rulings reflect a pattern of courts overstepping their authority and interfering with executive decision-making.
“So this is the attitude of these rogue federal judges…they say that the executive branch can only exercise its discretion in one direction,” he said.
With regard to the immigration ruling, Pulliam said it effectively preserves what he described as unlawful policy created under the Biden administration.
“So basically it’s de facto amnesty,” he said.
Turning to the White House case, Pulliam criticized the legal challenge brought by the National Trust for Historic Preservation, arguing it lacked legitimate standing.
“Their only stake in this is they say, we don’t like the way it looks… It’s aesthetic standing, which by itself is a joke,” he said.
Pulliam’s core argument focused on what he called a systemic issue within the federal judiciary, that, in his view, goes beyond individual rulings.
“This is a judicial insurrection… the executive branch is being blocked at every turn,” he stressed, arguing that such rulings create a one-way ratchet in policymaking.
“If you have somebody like Joe Biden who wants to open the borders… that’s fine… But then when you have another president who wants to come in and do the opposite… they say, oh no, you can’t do that,” he noted.
Pulliam warned that the cumulative effect of these decisions is to stall policy implementation and strain government legal resources.
“What they’re trying to do is to try to impede President Trump’s progress in making America great again,” he said, adding, “We cannot make America great again as long as we have these rogue judges engaged in judicial insurrection.”
