DOJ Says It Will Release Jack Smith’s January 6 Report

by | Jan 8, 2025

The Department of Justice (DOJ) submitted a court filing on Wednesday saying it will release Special Prosecutor Jack Smith’s January 6 report about President-elect Donald Trump.

Smith’s report contains information about Trump’s involvement in January 6 and his classified document case.

The DOJ said in its filing that the report was being released to inform “a co-equal branch and the public regarding this significant matter.”

Smith’s classified documents report will not be released due to ongoing legal proceedings of other defendants in that case, the filing says.

Trump is trying to prevent the federal government from releasing its report.

Lawyers for the president-elect wrote a letter to Attorney General Merrick Garland on Monday asking him not to release the reports.

“Smith’s proposed plan for releasing a report is unlawful, undertaken in bad faith, and contrary to the public interest,” the letter said.

“The time has come to put an end to this weaponization of the justice system and move forward constructively,” the letter added. “No report should be prepared or released, and Smith should be removed, including for even suggesting that course of action given his obvious political motivations and desire to lawlessly undermine the transition.”

On Tuesday, Judge Aileen Cannon delayed the release of Smith’s report.

In the court filing, the DOJ said that an injunction was not needed nor had a legal basis.

“The United States respectfully requests that, if this Court agrees that no injunction against the Attorney General is warranted, the Court should say so in an order binding on the district court and vacate the district court’s temporary injunction,” the filing says.

Trump is set to become president on January 20th.

The president-elect is also trying to prevent his criminal sentencing in the New York hush-money case.

Trump submitted an appeal to the Supreme Court. Justice Sonia Sotomayor will oversee his appeal.
